Binding Policy

This Return & Refund Policy ("Policy") is a binding disclosure of KiteHouse Labs, LLC ("Company," "we," or "us") to users and purchasers of our digital services. By making any purchase, you ("you" or "Purchaser") acknowledge that you have read, understood, and agree to be bound by this Policy. We offer lifetime access plans for digital services; all purchases are final and non-refundable except where otherwise required by applicable law.

1. Scope

This Policy applies to all purchases of digital services, products, and offerings made through the Services (including without limitation Vibez.lol, Perhaps.gay, and related domains operated by the Company). It is incorporated by reference into our Terms of Service and applies in addition to any purchase-specific terms. In the event of conflict between this Policy and the Terms of Service with respect to refunds, this Policy controls.

2. Definitions

For purposes of this Policy: "Services" means the websites, applications, and digital offerings operated by the Company. "Purchase" or "purchasing" means any transaction whereby you pay for access to or use of the Services or any paid feature. "Lifetime access" means access for the duration of the Service's operation by the Company—i.e., the lifetime of the Service (the platform), not your lifetime. The Service may be discontinued, shut down, or materially changed at any time at our sole discretion. Other capitalized terms have the meanings given in the Terms of Service or Privacy Policy.

3. Lifetime Access — Meaning and Service Discontinuation

"Lifetime" refers to the lifetime of the Service (the platform), not your lifetime. You understand and agree that when we offer "lifetime access," we mean access for as long as we continue to operate and make the Service available. We do not guarantee that the Service will remain available for any particular period. We may discontinue, suspend, shut down, or materially change the Service at any time, with or without notice, at our sole discretion (including for business, technical, legal, or other reasons).

No guarantee of continued availability

If you purchase today and we discontinue or shut down the Service tomorrow (or at any later time), your "lifetime" access ends at that time. You are not entitled to a refund, prorated or otherwise, or to any continued access, data export, or substitute service. You purchase with the understanding that the Service may cease to exist at any time. We have no obligation to keep the Service available for any minimum period.

4. No Refund Policy

The Company offers lifetime access plans for its digital services. Due to the digital nature of these offerings and the immediate access granted upon purchase, we maintain a strict no-refund policy for change of mind, partial use, or dissatisfaction. All purchases are final and non-refundable except where a refund is required by applicable law (see Section 5). We do not voluntarily provide refunds for change of mind, partial use, or dissatisfaction with the Services.

By completing a purchase, you acknowledge and agree that all sales are final except as required by law. You waive any right to request a refund, initiate a chargeback, or dispute the transaction with your payment provider, except where such right cannot be waived under applicable law. Unauthorized chargebacks or disputes may result in suspension or termination of your account and may be pursued to the fullest extent permitted by law.

5. Refunds Where Required by Law

Nothing in this Policy limits or excludes your mandatory legal rights. Where applicable law in your jurisdiction requires us to provide a refund (for example, statutory cooling-off or withdrawal rights that have not been validly waived, non-delivery of the purchased service, or where the service is defective and we cannot remedy it), we will provide a refund in accordance with that law. Eligibility and process may vary by jurisdiction. To request a refund that you believe is required by law, contact us at legal@kitehouse.us with your order details and the legal basis for your request. We will consider such requests in good faith and in accordance with applicable law.

This Policy does not affect your statutory rights.

If you are a consumer in a jurisdiction that grants non-waivable refund or cancellation rights (e.g., for non-conforming or undelivered goods or services), those rights remain available to you. We will not treat any term in this Policy as overriding such rights where the law does not permit it.

6. Digital Nature of Services

We provide digital services (e.g., link-in-bio pages, profiles, and related features). These are digital products or services that are delivered electronically with immediate access upon purchase. They cannot be physically "returned" and are not eligible for refund. Upon completion of your purchase, delivery is deemed to have occurred when access is granted. To the maximum extent permitted by applicable law, you have no right of withdrawal, cooling-off period, or cancellation once access has been provided. Any statutory rights that cannot be waived remain reserved.

7. Purchase Confirmation

Before completing any purchase, you are responsible for: (a) reviewing the features and terms included in your plan; (b) confirming that you understand this is a lifetime purchase with no refund option except where required by law; (c) having read and agreed to our Terms of Service and this Policy; and (d) verifying that your payment details and billing information are correct. We are not responsible for errors made by you during the purchase process, including incorrect payment information or mistaken purchases. All sales are final upon confirmation of payment.

8. Technical Support

We do not offer refunds but are committed to providing technical support on a best-effort basis so that you can access and use your purchase. If you experience technical issues, our support team may be available to assist in accordance with our support practices. Support is provided "as is" and does not create any obligation to provide a refund. Inability to resolve a technical issue does not entitle you to a refund, unless otherwise required by applicable law. We may modify or discontinue support offerings at any time without liability.

9. Changes to This Policy

We may modify this Policy at any time at our sole discretion. Changes are effective upon posting to the Services with an updated effective date. We are not obligated to provide individual notice. Changes do not affect the refund eligibility of purchases made before the change; the Policy in effect at the time of your purchase governs that purchase. Your continued use of the Services or any subsequent purchase after a change constitutes acceptance of the revised Policy.
