Terms of Service

The Company operates multiple websites and related services, including without limitation Vibez.lol, Perhaps.gay, and any other domains we own, operate, or acquire (collectively, the "Services"). These Terms apply to all access to and use of the Services, regardless of the domain through which you access them. Use of the Services is subject to these Terms and to our Privacy Policy, which is incorporated herein by reference.

Unless the context otherwise requires: "User Content" means any content, data, or materials you submit, post, or transmit through the Services. "Account" means the single unified account that may be used across all Services. "Prohibited Conduct" means conduct described in Section 7. Other capitalized terms have the meanings given in these Terms or in the Privacy Policy.

We operate a single, mandatory unified account system across all Services. There is no option for separate accounts by domain. By creating an Account, you agree that: (a) one Account is used across all Services; (b) credentials and profile data are synchronized across all Services; and (c) deletion of your Account applies globally and permanently across all Services. We do not maintain separate user databases or segments by domain. If you do not agree to a unified account, you must not use the Services.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Services. If you are under 18, you represent that you have the consent of a parent or legal guardian. You represent and warrant that you have the legal capacity to enter into a binding agreement, that all information you provide is accurate and complete, and that your use of the Services will comply with all applicable laws, rules, and regulations. The Services are not intended for users in jurisdictions where use would be prohibited.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. You agree to notify us promptly of any unauthorized access or use. We are not liable for any loss or damage arising from your failure to safeguard your credentials or from unauthorized use of your Account. We may suspend or terminate access where we reasonably suspect unauthorized or fraudulent use.

Ownership. You retain ownership of User Content you create or submit, subject to the license granted below.

License to Company. By submitting or posting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual license to host, store, reproduce, modify, adapt, display, distribute, and use User Content in connection with operating, providing, improving, and promoting the Services, in any media. This license survives termination of your Account to the extent necessary for the Company to fulfill legal obligations or exercise rights in de-identified or aggregated form.

Responsibility. You are solely responsible for User Content. You represent and warrant that User Content does not violate any law or third-party right (including intellectual property, privacy, or publicity rights) and is not unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable, and does not contain malware or other harmful code. We may remove or restrict User Content at any time, with or without notice, at our sole discretion, and we have no obligation to host or retain any User Content.

You agree not to, and not to permit others to: (a) violate any applicable law, regulation, or these Terms; (b) infringe or misappropriate any intellectual property, privacy, or other rights of the Company or any third party; (c) harass, abuse, harm, or defame any person; (d) upload, transmit, or distribute malware, viruses, or other harmful code; (e) attempt to gain unauthorized access to the Services, other accounts, or any systems or networks; (f) scrape, crawl, reverse engineer, or attempt to derive source code from the Services except as permitted by law; (g) circumvent or disable any security or access controls; (h) use the Services for any fraudulent or illegal purpose; or (i) interfere with or disrupt the integrity or performance of the Services. We may suspend or terminate your access immediately, with or without notice, for any actual or suspected Prohibited Conduct, without liability to you.

Certain features or offerings may require payment. By making a purchase, you agree to provide accurate and complete billing information, to authorize us (or our payment processors) to charge the applicable fees and taxes, and to pay all amounts when due. Unless otherwise stated or required by law, all payments are non-refundable. We may change fees or pricing upon reasonable notice to the extent permitted by applicable law. You are responsible for any taxes imposed on your use of the Services. Chargebacks or payment disputes may result in suspension or termination of your Account.

The Services may contain links to or integrate with third-party websites, applications, or services (including OAuth providers, payment processors, and analytics providers). We do not control and are not responsible for the content, privacy practices, or terms of any third party. Your use of third-party services is at your own risk and is subject to such third parties' terms and policies. We do not endorse and assume no liability for any third-party services.

We may suspend or terminate your Account or access to the Services, in whole or in part, at any time, with or without cause or notice, at our sole discretion, including for actual or suspected violation of these Terms, Prohibited Conduct, or for any other reason we deem necessary. You may terminate your Account at any time through account settings or by contacting us. Upon termination, your right to use the Services ceases immediately, and termination applies across all Services. We are not obligated to retain or provide copies of your User Content after termination. Sections that by their nature should survive (including Sections 6 (License), 10–13, 15–19) will survive termination.

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms or any law or third-party right; or (d) any dispute between you and any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and disclose information, including in response to law enforcement and legal process. By using the Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. We may disclose information to law enforcement or government authorities when required or permitted by law, as further described in the Privacy Policy.

We may modify, update, or discontinue the Services or these Terms at any time at our sole discretion. Material changes to these Terms will be posted on the Services with an updated effective date. We are not obligated to provide individual notice. Your continued use of the Services after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Services. We may impose limits on certain features or restrict access to parts of the Services without liability.

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction and venue of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision, and these Terms shall be construed as if such provision had never been included. The remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy and any other policies or guidelines we post on the Services, constitute the entire agreement between you and the Company regarding the Services and supersede all prior and contemporaneous agreements, proposals, and understandings, whether written or oral. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
